I bought my beetle last year October.

Paid for the car on collection but the "owner" didn't have the papers with her for it was at her ex-husbands place in PTA. Was promised that I would have the papers that Wednesday. After weeks of struggling getting the papers from her it came out that the car is still registered in the previous owners name.

I got hold of the previous owner and without a blink of an eye he said that he lost the papers but he will get duplicate papers that week still.

Needless to say 6 months later still no papers. I've been told so many bullshit stories I can write a book.

I have now resorted to taking the legal route and must say lawyers fees are not cheap.

So with all of above said my project has come to a standstill till I have the papers in my hands, as is I have spend thousands already and don't want to spend anymore just in case this is a scam.

So guys, don't ever buy a car without having the papers in hand. This has been a nightmare for me

Rule #1, you never ever pay for a car without having the papers.

Go and make a affidavit, then take the car for police clearance, provide proof of all work with regards to obtaining papers and submit at traffic department. Provide proof of purchase too.

I have opened a case at the police ( with all documentation and communication) and handed it over to my lawyer.....

Obviously lawyer fees will be at the previous owners account, Currently sitting at 6k

Sorry to hear man.. Agreed with what Sean said. Whats mind-blowing is how when you challenge people selling vehicles without papers, they get so defensive. Its clearly not legal to do so, and unfortunately for you, you've burnt more than your fingertips.

I think you need to cut your losses and try to get the beetle on your name and forget about the rest.

In this case, the attorney can only bark and the bite is going to cost a whole lot more than what the car is worth as it will need to go to court. I’m doubtful that SAPS will do anything even if they could.

I’m not sure how the small claims court work and if you need to prove if you have suffer a financial loss.

Find out on who's name it is, and go to that person, let them give you power of attorney, and you go get the duplicate papers you self.

That will speed up the process, and cut out the bull and it will cost far less then the lawyer that sits on his making money on every e-mail he sends, not wanting to solve this issue else no Merc, payments....

You will land up paying the Lawyer, as proof of deception is very difficult, all he needs to produce is an old till slip and say that was the papers he was talking about

All he has to do with each speeding fine is to send slip back saying he wasn't the driver of the vehicle.

Or he could turn around and report the car stolen.

If he won't give power of attorney as suggested already, maybe look for a decent chassis and do a transplant.
