Trailer companies win against transport minister

Post by Dawie »

Trailer rent companies took the transport minister to court to have fines declared void.

Damn right!

The court clearly spelled out that the Road Traffic Act says that the driver of a vehicle is responsible for any offences they commit. The act also provides that the owner is assumed to be the driver until they present evidence to the contrary. This applies where the fine is not issued to the driver, but sent in the post as a result of an offence captured on camera, such as speeding fines. The court clarified that if the driver is responsible, it follows that only a vehicle capable of being driven can be targeted for a camera fine.

The DoT had been sending speeding fines to trailer hire companies where the trailer's plate was captured by the camera and the trailer obscured the car's plate.

I once got a camera speeding fine issued against my trailer when I was towing it with my Autovilla (quite an achievement!). The Autovilla's plate was also visible in the image. I just ignored it and that's the last I heard of it.

LOL...

No one can beat my trailer as it was clocked at 162 Kph in Cape Town, while being parked in my lean to with flat tyre's in Port Elizabeth.

Talk about a split personality trailer.....
