Cease and Desist

Post by dsan »

Oh how I love Americans sometimes, their view of the world and patents are cute, in a weird way.
This was just sent to me, most likely as I used the term "volksville"

Hi Daniel,

My Name is Cesar I'm the designer/owner of Volksville.com, I need you to CEASE & DESIST any more use of the volksville name and concepts.

Cesar
Volksville.com
Now this wound me up, I f#Ck hate it when someone tells me what to do without engaging first gear and thinking. My response:
Cesar,

Whilst I applaud your website, you will see that I am not based in the US, so therefore your cease and desist means practically nothing to me, as a citizen of a country not bound by US law or patents. Incidentally, your term "volksville" has not been registered as a trademark according to your own countries trademark authority:

http://tess2.uspto.gov/bin/showfield?f= ... bmit+Query

You seem to think i'm abusing the term "volksville", yet don't back it up with any proof of the sort.

Interestingly, there are other "violators" of your name I thought you'd be interested in:

http://www.rootsweb.ancestry.com/~mnblu ... ships.html
They seem to have a town named after it,

http://www.sahistory.org.za/franco/urba ... ville.html
Extension 4 is also known as volksville

Australia even has a company called volksville
http://www.electrician.com.au/volksville-pty-ltd-/

So, as you can see, there are many fine folk out there using the term "volksville". What I'd suggest is you register the trademark in the US and then once approved, lawyer up against all these people using your name.

Until then, have a good night.
Cease and desists are interesting. They are meant to prevent illegal activity from taking place. Often they are issued by a judge, but in most cases anyone can issue them. Problem is, when you are trying to get someone to stop using a term you have decided to use, and not really applied to legally prevent anyone else using it, you just look like a cock.

He's not a twat, just a person who decided on a strong arm tactic when a simple, polite, email would have done.
